By accessing our website, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or place an order.

1. General

By using our website, you represent that you are at least 18 years of age, or that you are using the website with the consent and supervision of a parent or legal guardian.

You agree to use our website and services only for lawful purposes and in accordance with these Terms.

We reserve the right to update, modify, suspend, or discontinue any part of our website, products, services, or these Terms at any time. Changes will become effective when posted on our website unless otherwise stated.

2. Products

Isla De Cacao offers premium chocolate, cacao, and confectionery products.

We make every reasonable effort to ensure that product descriptions, ingredients, nutritional information, packaging, photographs, pricing, and other product details displayed on our website are accurate and up to date.

However, slight variations may occur due to manufacturing or packaging updates, natural variations in ingredients, or differences in individual device displays.

All products are subject to availability. We reserve the right to limit quantities, discontinue products, or modify product specifications and offerings without prior notice.

For questions regarding ingredients, allergens, product specifications, or suitability for a particular dietary requirement, customers are encouraged to contact us before placing an order.

3. Food Safety and Product Handling

At Isla De Cacao, we are committed to maintaining high standards of food safety, hygiene, and product quality.

Our facilities, equipment, and food preparation areas are regularly cleaned, sanitized, and maintained in accordance with applicable food safety and hygiene requirements.

We follow appropriate food handling, preparation, storage, and packaging practices to help ensure that our products are produced and handled in a clean and safe environment.

Because chocolate and cacao products can be sensitive to temperature and environmental conditions, customers are responsible for following the recommended storage instructions after delivery. Proper storage helps preserve the product's quality, appearance, flavor, and freshness.

4. Pricing

All prices displayed on our website are in Philippine Pesos (PHP) unless otherwise indicated.

Prices, product specifications, and promotional offers are subject to change without prior notice.

While we make every effort to ensure that pricing information is accurate, errors may occasionally occur. If a product has been listed at an incorrect price, Isla De Cacao reserves the right to correct the price or cancel the affected order.

If an order is cancelled because of a pricing error after payment has been received, the customer will receive a full refund of the amount paid for the affected order.

5. Orders and Order Acceptance

When you place an order through our website, you are submitting a request to purchase the selected products. Your order confirmation does not necessarily constitute our final acceptance of the order.

Isla De Cacao reserves the right, where reasonably necessary, to:

  • Accept or decline an order.

  • Cancel an order suspected of fraud, unauthorized activity, or misuse of our website.

  • Limit the quantity of products purchased by a customer or household.

  • Cancel orders affected by pricing, inventory, or product information errors.

  • Refuse or restrict service where permitted by applicable law.

If we cancel an order after payment has been received, the applicable amount will be refunded through the original payment method or another appropriate method, subject to the payment provider's procedures.

6. Payment

Payments are securely processed through Shopify and its authorized payment providers.

Depending on availability and your location, available payment methods may include:

  • Credit and debit cards

  • GCash

  • Maya

  • Online banking

  • Cash on Delivery, where available

  • Other payment methods displayed at checkout

Isla De Cacao does not store customers' complete payment card information. Payment information is handled by Shopify and/or the applicable authorized payment provider in accordance with their respective security and privacy practices.

7. Shipping and Delivery

Shipping and delivery timelines will be agreed upon between Isla De Cacao and the customer at the time the order is placed, based on product availability, order requirements, destination, selected shipping method, and applicable courier arrangements.

The agreed shipping or delivery timeframe may vary depending on:

  • Product availability and preparation requirements

  • Customer's delivery location

  • Selected courier or shipping service

  • Weather conditions and natural events

  • Public holidays

  • Peak seasons or high order volumes

  • Transportation or courier disruptions

  • Other circumstances beyond our reasonable control

Any shipping or delivery timeframe communicated or agreed upon at the time of ordering is an estimate unless expressly confirmed as a guaranteed delivery date.

Customers are responsible for providing complete and accurate shipping information, including the recipient's name, contact number, and delivery address.

Isla De Cacao cannot be held responsible for delivery delays, failed delivery attempts, returned parcels, or additional shipping charges resulting from incorrect, incomplete, or outdated information provided by the customer.

Once an order has been properly handed over to the designated courier for delivery, responsibility for transportation and delivery is subject to the courier's applicable terms and conditions.

8. Temperature-Sensitive Products

Chocolate is naturally sensitive to heat and temperature fluctuations. During warm weather or extended transit, chocolate may soften, develop minor surface changes, or partially melt.

Isla De Cacao takes reasonable care in preparing and packaging orders for shipment. However, we cannot guarantee that temperature-sensitive products will arrive completely unaffected by heat during transportation.

Minor cosmetic changes caused by normal temperature exposure during transit do not necessarily affect the safety or quality of the product and generally do not qualify for a refund or replacement.

If a product arrives damaged, defective, incorrect, or otherwise appears unsafe to consume, please contact us within the timeframe specified in our Refund and Replacement Policy so that we can review the issue and assist you.

9. Returns, Refunds, and Replacements

For food safety and hygiene reasons, food products generally cannot be returned once they have been delivered to the customer.

We want you to be satisfied with your purchase. Refunds or replacements may be considered when:

  • You received an incorrect product.

  • An item was missing from your order.

  • A product arrived damaged.

  • A product arrived defective.

  • Another issue occurred that is reasonably attributable to our fulfillment of the order.

To request a refund or replacement, please contact Isla De Cacao within 48 hours of delivery.

To help us resolve your concern promptly, please provide:

  • Your order number.

  • Clear photographs of the product received.

  • Clear photographs of the packaging and shipping parcel.

  • A brief description of the issue.

  • Any other information reasonably requested by our customer service team.

Each request will be reviewed individually. Where a refund is approved, it will generally be processed using the original payment method, subject to the processing time of the applicable payment provider.

Nothing in these Terms is intended to limit any rights or remedies that cannot legally be excluded under applicable Philippine law.

10. Promotions, Vouchers, and Discount Codes

Promotional offers, vouchers, and discount codes are subject to their specific terms and conditions.

Unless otherwise stated:

  • Promotional codes have no cash value.

  • Promotional codes cannot be combined with other discounts or promotions.

  • Promotional codes are valid only during the stated promotional period.

  • Promotional codes may be subject to minimum purchase requirements or other restrictions.

  • Promotions may be modified, suspended, or discontinued where permitted by law.

Expired promotional codes cannot be reinstated unless expressly authorized by Isla De Cacao.

11. Intellectual Property

All content appearing on the Isla De Cacao website, including but not limited to:

  • Brand names and logos

  • Product photographs

  • Product packaging images

  • Graphics and illustrations

  • Website design and layout

  • Product descriptions

  • Written content

  • Trademarks and other brand assets

is owned by Isla De Cacao or used under appropriate authorization and is protected by applicable intellectual property laws.

You may not reproduce, copy, modify, distribute, publish, transmit, sell, or otherwise use our content for commercial or other purposes without our prior written permission, except where permitted by applicable law.

12. Website Use

You agree not to misuse our website or interfere with its normal operation.

You must not use our website to:

  • Engage in fraudulent or unlawful activities.

  • Attempt to gain unauthorized access to our systems or accounts.

Isla De Cacao shall not be responsible for delays or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control.

  • Government actions or restrictions

  • Transportation or courier disruptions
